Offering Terms of Use Agreement - Use of the Offering is subject to the following Terms of Use

General

The website www.EspnCricket.Net (the “Site”) is maintained and operated by EspnCricket, Inc. (together with its agents who assist in operating the Site). You may not modify, transmit, reuse, re-post, or prepare derivative works based upon the Site, or perform or display the materials contained on the Site for public or commercial purposes, including the text, images, audio and video, without first obtaining the written permission of EspnCricket, Inc.

Your access to and use of the Site is subject to these Terms and Conditions and all applicable laws. By accessing and browsing the Site, you accept, without limitation or qualification, the Terms and Conditions. EspnCricket reserves the right to terminate any Account that is used in violation of these Terms and Conditions.

You should assume that everything you see or read on the Site is copyrighted material unless otherwise noted, and may not be used except as provided in these Terms and Conditions or in the text on the Site without the written permission of EspnCricket TV. EspnCricket neither warrants nor represents that your use of materials displayed on the Site will not infringe rights of third parties not owned by or affiliated with EspnCricket TV.

Use of Subscription Services

To access the services available for purchase on the Site (the “Subscription Services”) you must set up an Account. To do this you must complete and submit the Registration Form provided on the Site. By so doing:

You confirm and warrant that all the information supplied by you when you register for the Subscription Services is true, current, complete and accurate in all respects.
You warrant that you are entitled to receive e-mails at the e-mail address which you provide to EspnCricket. You agree that, on request by any employer or institution, EspnCricket TV may cease, without notification to you, sending e-mails to your e-mail address which is accessible through that employer's or that institution's network.
Where you elect to purchase a Subscription Service, you agree to EspnCricket TV’s collection of the subscription charges associated with the Subscription Services you select (the “Subscription Charges”), through your credit (or debit) card account (submitted by you to us) at the time of purchase of the event package(s).
You agree to promptly update your registration information through the online editing facility provided, so that your Registration Form remains true, current, complete, and accurate. If EspnCricket TV believes that you have provided false information or failed to notify EspnCricket TV of any changes EspnCricket TV reserves the right to terminate your access to the Subscription Services immediately without notice or refund, as applicable.
You acknowledge and agree that your registration information and any other personal data collected by EspnCricket TV is subject to EspnCricket TV’s Privacy Policy. For more information, view the full Privacy Policy at EspnCricket TV..
You acknowledge that EspnCricket TV may refuse any registration application at its sole discretion.
You acknowledge, consent and agree that EspnCricket TV may access, preserve, and disclose your account information if required to do so by law or in a good faith belief that such access, preservation, or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the Terms and Conditions; (c) respond to your requests for customer service; or (d) protect the rights, property or personal safety of EspnCricket TV, its users and the public.
You acknowledge that EspnCricket TV cannot guarantee that your access to the Site or the Subscription Services will be uninterrupted or error-free, but EspnCricket TV will correct reported problems as soon as EspnCricket TV can reasonably do so. If a problem occurs, you should report the problem to support@EspnCricket.net
You acknowledge that the Site and the Subscription Services are accessed via a telecommunications connection. You are responsible for the provision of and payment for telecommunications services plus a suitable PC, modem and any other items of hardware or communications equipment necessary to enable you to access the Site and the Subscription Services. EspnCricket TV will not be responsible, nor will EspnCricket TV issue refunds to Subscription Charges, for disruption, unavailability, or failure in your telecommunications equipment or services.
You agree that EspnCricket TV may temporarily suspend access to the whole or any part of the Site or to the Subscription Services for any reason at its sole discretion. EspnCricket TV may, but shall not be obliged to, give you as much notice of any interruption of access to the Site or Subscription Services as is reasonably practicable. EspnCricket TV will restore access to the Site and the Subscription Services as soon as reasonably practicable after temporary suspension. EspnCricket TV shall not be liable to you for any loss that you may incur as a result of such suspension or delay.
You acknowledge that while EspnCricket TV shall take all reasonable steps necessary to ensure a high quality video feed. EspnCricket TV cannot control Internet network congestion that may occur and affect the quality of the delivered video. EspnCricket TV is also not responsible for any suspension of service that may occur in the live video feed that is received from the television broadcaster.
You agree that EspnCricket TV shall be under no liability whatsoever to you in the event of non-availability of any portion of the Site or Subscription Services occasioned by Act of God, war, disease, revolution, riot, civil commotion, strike, lockout, flood, fire, satellite failure, failure of any public utility, undertaking or any other cause whatsoever beyond the control of EspnCricket TV.
You represent that you are a resident of the United States, Canada, or Mexico. At the present time, residents of other countries are not eligible to register for CRICKETTICKET. If EspnCricket TV believes that you have provided false information or failed to notify EspnCricket TV of any changes to your location, EspnCricket TV reserves the right to terminate your access to the Subscription Services immediately without notice or refund, as applicable.
You agree that in order to access and use the Subscription Services you will choose a unique user ID and password (the "Password"). You are responsible for the security and proper use of your user ID and Password and must take all necessary steps to ensure that they are kept confidential, used properly, and not disclosed to unauthorized people.
You acknowledge and agree that you will inform EspnCricket TV immediately if you have any reason to believe that any Password has become known to someone not authorized to use it or if any Password is being or is likely to be used in an unauthorized way. If EspnCricket TV have reason to believe that there is likely to be a breach of security or misuse of the Subscription Services, EspnCricket TV may change any or all of your Passwords immediately and will notify you accordingly.
You acknowledge that, in the event you forget your user ID or Password, you may obtain a new Password enabling access to the Subscription Services by contacting support@EspnCricket.net and satisfying the security checks EspnCricket TV operates.
You agree that each registration is valid for a single individual user only, and you are prohibited from sharing your Password with third parties. You are responsible for ensuring that no unauthorized access is obtained to the Subscription Services through your Account. You will be entirely liable for all activities conducted and charges incurred through your Account, whether authorized by you or not.
You acknowledge that use of the Site or Subscription Services will use or cause to be used EspnCricket TV servers located in California. Any unauthorized use of EspnCricket TV servers is a violation of these Terms and Conditions and certain federal and state laws.

Changes to Subscription Services

EspnCricket TV reserves the unrestricted right to change, rearrange, add or delete our Subscription Services offerings, the selections in those offerings, our prices, and any other service we offer, at any time. We will endeavor to notify Subscribers to the Site of any such change that is within our reasonable control and its effective date. You have the right to cancel your Subscription Service if you do not accept the change, by notifying us at support@EspnCricket.net, and EspnCricket TV will apply the appropriate credits, if any, to your account. If you do not cancel, your continued receipt of our Subscription Services will constitute acceptance of any and all such changes.

Disclaimer of Warranties

EspnCricket TV makes no warranties or representations as to the accuracy of any content on the Site, and assumes no liability or responsibility for any errors or omissions in the content of the Site.

Your use of and browsing in the Site are at your risk. Neither EspnCricket TV nor any other party involved in creating, producing, or delivering the Site is liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of, the Site. Without limiting the foregoing, everything on the Site is provided to you "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Please note that some jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. Any such exclusion shall be deemed severable from the other terms in this Disclaimer, and all other terms shall be given full force and effect. Check your local laws for any restrictions or limitations regarding the exclusion of implied warranties. EspnCricket TV also assumes no responsibility, and shall not be liable fo r, any damages to your computer equipment or other property on account of your access to, use of, or browsing in the Site or your downloading of any materials, data, text, images, video, or audio from the Site.

EspnCricket TV has not reviewed all of the sites linked to the Site and is not responsible for the content of any off-site pages or any other sites linked to the Site. Your linking to any other off-site pages or other sites is at your own risk. EspnCricket TV is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources.

No Unauthorized Use

Images of people or places displayed on the Site are either the property of, or used with permission by, EspnCricket TV. The use of these images by you, or anyone else authorized by you, is prohibited unless specifically permitted by these Terms and Conditions or specific permission provided elsewhere on the Site. Any unauthorized use of the images may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes.

The trademarks, logos, and service marks (collectively, the "Trademarks") displayed on the Site are registered and unregistered Trademarks of EspnCricket TV and others. Nothing contained on the Site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on the Site without the written permission of EspnCricket TV or such third party that may own the Trademarks displayed on the Site. Your misuse of the Trademarks displayed on the Site, or any other content on the Site, except as provided in these Terms and Conditions, is strictly prohibited. You are also advised that EspnCricket TV will aggressively enforce its intellectual property rights to the fullest extent of the law, including the seeking of criminal prosecution.

No Resale of Service

You agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the Site or any use or access of the Subscription Services.

Choice of Law

The relationship between you and EspnCricket TV shall be governed by the laws of the State of California without regard to its conflict of law provisions, with the exception of the dispute resolution procedures below which will be governed by the Federal Arbitration Act.

Revisions

EspnCricket TV may at any time revise these Terms and Conditions by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the then current Terms and Conditions to which you are bound.

Severability

If any provision of these Terms and Conditions is held invalid, void, or unenforceable, then that provision shall be considered severable from the remaining provisions, and the remaining provisions given full force and effect.

Integrated Agreement

These Terms and Conditions constitute the entire agreement between you and EspnCricket TV governing your use of the Site and Subscription Services, superceding any prior agreements between you and EspnCricket TV regarding such use. You may also be subject to additional terms and conditions that may apply when you use or purchase other EspnCricket TV services.
